Terms of Use

These Terms of Use ("Terms") govern your use of Escape Hatch (the "App"), developed by Tumblefern, Inc. ("Tumblefern," "we," "us," or "our") under our Product Lab venture. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Description of the App

Escape Hatch is an educational savings and retirement projection calculator. It helps you explore long-term financial scenarios by adjusting inputs such as starting balance, contribution amount, interest rate, time horizon, inflation assumptions, and payout estimates, and by viewing growth charts, scenario comparisons, and shareable projection summaries.

2. Educational Use Only — No Financial, Investment, Tax, or Legal Advice

Escape Hatch is built for planning and education only. It does not provide financial, investment, tax, legal, or retirement advice, and nothing in the App should be construed as such. Projections are based entirely on the assumptions you enter and are not guarantees of future results — actual outcomes may differ materially due to market conditions, fees, taxes, inflation, and other factors the App does not account for. Always consult a qualified financial advisor, tax professional, or attorney before making financial or retirement decisions.

3. Eligibility

The App is intended for a general audience and does not knowingly collect information from anyone. If you are under the age of majority in your jurisdiction, please use the App only with the involvement of a parent or guardian.

4. License to Use the App

Subject to these Terms, Tumblefern grants you a limited, non-exclusive, non-transferable, revocable license to download and use Escape Hatch on Apple-branded devices that you own or control, solely for your personal, non-commercial use, in accordance with Apple's Usage Rules set out in its App Store Terms of Service.

5. Your Data and Inputs

You are solely responsible for the accuracy of any figures you enter into the App. Escape Hatch performs calculations based only on the inputs you provide and stores them locally on your device as described in our Privacy Policy. We have no visibility into, and no responsibility for, the accuracy or real-world applicability of your inputs or the resulting projections.

6. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that calculations will be error-free, that projections will reflect actual future outcomes, or that the App will be uninterrupted or free of defects.

7. Limitation of Liability

To the fullest extent permitted by law, Tumblefern, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or financial loss, arising from or related to your use of, or reliance on, the App or its projections, even if advised of the possibility of such damages.

8. Intellectual Property

The App, including its name, design, logo, and underlying code, is owned by Tumblefern, Inc. and protected by applicable intellectual property laws. These Terms do not grant you any rights to Tumblefern's trademarks, logos, or brand assets beyond what is necessary to use the App as licensed above.

9. Apple App Store Terms

Because Escape Hatch is distributed through the Apple App Store, the following additional terms apply:

• These Terms are between you and Tumblefern, Inc. only, not Apple Inc. ("Apple"), and Apple is not responsible for the App or its content.
• Apple has no obligation to furnish any maintenance or support services for the App.
• In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims by you or a third party relating to the App, including product liability claims, legal or regulatory compliance claims, or claims arising under consumer protection law.
• Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the App infringes intellectual property rights.
• You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right to enforce these Terms against you.

10. Termination

We may suspend or discontinue the App, or your access to it, at any time. Since the App stores no account with us, termination generally means the App is no longer available for download or update; any locally stored data on your device remains yours to delete by removing the App.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after an update constitutes acceptance of the revised Terms. Material changes will be reflected in an updated "Last Updated" date above.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the state and federal courts located in Dallas County, Texas.
